Don't Let Tallyween Haunt Your Future: Staying Safe this Season

Tallyween transforms Tallahassee into the ultimate Halloween destination, with thousands of Seminoles and locals celebrating from Gaines Street to Collegetown, Midtown to FSU campus. But amid the excitement, Tallahassee roads can become dangerously crowded with impaired drivers. One decision to drive after celebrating can turn Tallyween into a night that haunts you

forever.

A first-time DUI conviction in Leon County under Florida Statute § 316.193 could mean serious consequences: hundreds to thousands of dollars in court costs, fines, and Uber fees, possible jail time, drivers license suspension, mandated community service, vehicle impoundment, and DUI school. FSU, FAMU, and TSC students under 21 could face even harsher treatment — beyond court, you'll face university conduct hearings that can result in suspension, loss of Bright Futures, and a disciplinary record that follows you like a ghost and is visible to graduate schools and employers. Factor in representation fees, heightened insurance rates, ignition interlock devices, and probation fees, and a single DUI easily costs thousands.

So, plan ahead. Download Uber and Lyft, save City Taxi (850-575-1111) and Yellow Cab (850-580-8080), or use StarMetro and Seminole Express routes. Remember: Florida law means you can be arrested for DUI even below .08 BAC if you appear impaired. Refusing a breathalyzer triggers a one-year suspension under Florida's Implied Consent law (§ 316.1932), and that refusal can be used against you in court. Leave your car downtown and get it tomorrow—towing fees beat a DUI arrest every time. Don't let the real nightmare begin when the party ends.

If your friend, or you yourself are arrested this Tallyween, act fast. You can exercise your right to remain silent and contact an experienced DUI defense attorney immediately. We can challenge

the legality of your stop, question field sobriety test administration, scrutinize breathalyzer calibration records, and fight for reduced charges or case dismissal. Most cases have defenses. The Leon County Sheriff's Office and TPD may run DUI checkpoints throughout Halloween night—stay safe, plan your ride, but if you need help, know that your constitutional rights and your future are worth protecting.

Happy Halloween, and Go Noles!
